JUST IN: Presidential Candidates Not Mandated to Score 25% Votes in FCT – Supreme Court

The Supreme Court has upheld the ruling of the Presidential Election Petitions Tribunal on 25 percent of votes in Abuja.

Judge Okoro pointed out that a candidate does not have to receive 25% of the vote in the Federal Capital to be declared the winner of the presidential contest.

According to Sections 134(1) and (2) of the 1999 Nigerian Constitution (as amended), in order to be deemed legally elected as President of Nigeria, a presidential candidate must receive or score a majority of the votes cast in a presidential election involving two or more candidates and at least 25% of the votes cast in two-thirds of the 36 states and the Federal Capital Territory.

On September 6, the tribunal ruled that the Federal Capital Territory is on par with the other states in the nation.
